Terms of Use for TOHSAKAN Application

Welcome to TOHSAKAN, a journey & content-driven travel application operating under the BENJARONG Ecosystem. Please read these Terms of Use carefully. By downloading, accessing, or using the application, you agree to be bound by these terms.

Modules Not Yet Available in This Release

TOHSAKAN is released in stages. The services below are described in these terms because they form part of the BENJARONG Ecosystem design, but they are not active in the current App Store release. Sections referring to them take effect only once the corresponding module is enabled, and these terms will be updated before that happens.

  • Smart Safety — proactive geofencing, SOS dispatch, and coordination with law enforcement.
  • Health Care — vital-sign monitoring, fall detection, and the Medical Safety Net.
  • Wallet, KYC verification, and Benjarong Points redemption.
  • Form-Fill Assistant for digital arrival forms (TDAC).

1. Scope of Services

TOHSAKAN provides an intelligent travel platform offering:

  • Content & Discovery — Short-form video feeds, live streams, and travel inspiration.
  • Travel Booking & Commerce — Integrated journey bookings (accommodation, transport, activities, dining, community markets, and OTOP/Marketplace).
  • Smart Safety & Health Care — Proactive security monitoring (in coordination with local law enforcement and geofencing) and health/vital sign tracking (Medical Safety Net).
  • Gamification & Rewards — Digital Tourism Passport (Tohsakan Passport), stamp collection, and Benjarong Points redemption.
  • Form-Fill Assistant — In-app assistance for pre-filling digital entry forms (e.g., TDAC).

2. User Account & KYC Verification

  • Users must provide accurate and complete information during registration.
  • To access Wallet withdrawal features or premium tiers, users may be required to complete Identity Verification (KYC) in compliance with applicable laws.
  • Users are responsible for maintaining the confidentiality of their account credentials.

3. Smart Safety & Health Care Disclaimers

  • Smart Safety — Location-sharing and SOS emergency dispatch features act as proactive assistance tools and do not constitute an absolute guarantee of safety against accidents or unexpected hazards.
  • Health Care — Data collected from Smart Watches or interactive health cards is used solely for emergency response coordination and does not constitute medical diagnosis or advice.
  • Data Retention — Safety monitoring data adheres to a Time-bound Privacy Policy based on your trip duration. Personal tracking data is locked/deleted within 24 hours post-trip in accordance with PDPA regulations.

4. User-Generated Content & Creator Conduct

  • Users and Creators are solely responsible for all content, videos, text, or links published on the platform.
  • Content that is illegal, defamatory, infringing on intellectual property, or sexually explicit is strictly prohibited.
  • By tagging booking links (Booking Pills) to content, Creators warrant that the tagged services are accurate and non-misleading.

5. Bookings, Payments, and TOHSAKAN+ Subscription

  • Transactions — Bookings are processed via secure payment gateways. Cancellation and refund policies are governed by the specific terms of each booking domain.
  • TOHSAKAN+ — Subscription unlocks exclusive VIP perks (e.g., Zero Booking Fees, enhanced safety features). Subscription fees are non-refundable unless specified otherwise and benefits are non-transferable.

6. Form-Fill Assistant & Third-Party Integration

  • The app includes an In-App Form-Fill Assistant that auto-fills user data onto third-party government/external forms (e.g., Thailand Digital Arrival Card - TDAC) via client-side automation for convenience.
  • TOHSAKAN operates purely as a user-side facilitator and is not an official representative or affiliate of immigration authorities. Approval of entry forms remains solely at the discretion of the respective authority.

7. Limitation of Liability

TOHSAKAN and the BENJARONG Ecosystem shall not be liable for any direct, indirect, or consequential damages arising from services provided by third-party merchants (hotels, transport operators, activity providers) or system interruptions caused by force majeure.
